Terms of Service

1. Agreement to these Terms
Hootenanny (the "Service") is operated by Egregius Digital, a sole proprietorship based in Alberta, Canada ("we," "us," "our"). By creating an account, accessing, or using the Service, you agree to these Terms of Service and to our Privacy Policy. If you do not agree to these Terms, you are prohibited from accessing or using the Service.
2. Who can use Hootenanny
You must be at least 13 years old to create an account. To purchase a paid photo album you must be the age of majority in your province or territory (18 in Alberta), or have a parent or guardian who consents and agrees to these Terms on your behalf. The Service isn't directed to children under 13, and we don't knowingly let them create accounts.
Guests don't need an account. Anyone with an event link can RSVP without signing up; these Terms apply to them only to the extent they use the Service.
3. What Hootenanny does
Hootenanny helps you plan get-togethers: share an invite link, collect RSVPs and headcounts, coordinate who's bringing what, and add events to a calendar. Creating events and collecting RSVPs is free. The only paid feature is an optional, per-event shared photo album. We may add, change, or discontinue features over time.
4. Your account
Keep your login credentials confidential, keep your information accurate, and tell us promptly if you suspect unauthorized access. You're responsible for activity under your account. We may suspend or close accounts that present a security risk or breach these Terms.
5. Photo albums and your content
A photo album is a one-time, per-event purchase. Viewing and uploading photos require a signed-in account (uploads are attributable; on PIN-protected events, album access also requires having entered the event PIN). You keep ownership of the photos and content you upload. You grant us a limited, non-exclusive license to host, store, resize, strip location/EXIF metadata, safety-scan, display, and deliver your photos for the purpose of running that event's album. Albums auto-expire on their timer (see pricing), after which the photos are deleted — download anything you want to keep before then. (The event's cover image is the exception: it stays with the event page until the host removes it or the event is deleted.)
When you add photos to an event's album, you also grant the host and anyone else with access to that album a non-exclusive license to view, download, and keep your photos for their own personal, non-commercial use in connection with the event.
You're responsible for having the right to upload what you share, including the consent of people who appear in your photos (and, for images of minors, the consent of a parent or guardian).
6. Acceptable use
You agree not to upload, share, or use the Service for:
- anything illegal — and never any content that sexualizes or exploits a minor (we report such material to the authorities, including NCMEC);
- adult, sexually explicit, or graphically violent content (Hootenanny is for everyday get-togethers and is kept appropriate);
- content you don't have the rights to, or that infringes someone else's rights;
- harassing, hateful, or deceptive content, or impersonating others;
- breaking, overloading, scraping, reverse-engineering, or gaining unauthorized access to the Service.
We scan uploaded photos for safety (see the Privacy Policy) and may remove content, suspend accounts, and report illegal material to law enforcement.
7. Payments and refunds
An album is digital content. After you buy it, its upload window opens at the start of your event (not at the time of purchase) and stays open until it expires. You can cancel for a refund while it's still unused, before your event starts; once it opens at your event's start we have begun supplying it, and you may lose any statutory right to cancel. On the web, albums are sold through Paddle, our Merchant of Record, which processes the payment and any applicable taxes; in our mobile apps, they're sold through the Apple App Store or Google Play. Prices are shown before you buy. Refunds are governed by our Refund Policy (and, for app-store purchases, by that store's policies).
8. Third-party services
The Service runs on third parties including Google Firebase / Google Cloud, Paddle, Resend (email), Google Analytics, and Google Cloud Vision. We're not responsible for third-party services beyond our reasonable control.
9. Availability
The Service is provided on an "as is" and "as available" basis. We don't guarantee it will be uninterrupted or error-free. Keep your own copies of anything important — especially photos before an album expires.
10. Intellectual property
Hootenanny and everything that makes up the Service are owned by Egregius Digital. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service. You keep your own content.
11. Disclaimer of warranties
To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages. Our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amount you paid us in the twelve (12) months before the event giving rise to the claim, or CAD $20. Nothing in these Terms limits liability that can't be limited under applicable law.
13. Indemnity
You agree to indemnify and hold harmless Egregius Digital from claims arising out of your misuse of the Service, your content, your breach of these Terms, or your violation of any law or third-party right.
14. Suspension and termination
We may suspend or terminate access for breach of these Terms, fraud, security risk, or unlawful content. You can stop using Hootenanny at any time. Deleting your account removes your personal data as described in the Privacy Policy.
15. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. You agree to the exclusive jurisdiction of the courts of Alberta.
16. Changes to these Terms
We may update these Terms. For material changes we'll give at least 14 days' notice (for example, by email or in the app) before they take effect, and we may ask you to re-accept them. Continued use after the effective date means you accept the updated Terms. Each version is dated at the top of this page.
17. General
If any provision is found unenforceable, the rest stays in effect. These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If we don't enforce a provision, that isn't a waiver of it.
